- Move resident demat holdings to an NRO non-PIS demat by off-market transfer; no need to sell.
- Use NRE PIS for fresh repatriable investment; no intraday or short selling for NRIs.
- Update every mutual fund folio and SIP mandate separately; TDS applies to NRI gains and dividends.
When does this need to be done?
Under FEMA, you become a non-resident as soon as you leave India for a job or to live abroad, not at the end of the tax year. Your broker, depository participant and fund houses should be told promptly. Holding shares in a resident account after your status has changed is a compliance gap, and brokers can take a week or more to process the paperwork.
Shares: resident demat to NRI demat
| Account | Linked bank | Use it for |
|---|---|---|
| NRO non-PIS demat and trading | NRO account | Shares you already hold from your resident days. Sale proceeds are non-repatriable, but can be sent abroad within the NRO limits with Form 15CA/15CB |
| NRE PIS demat and trading | NRE account | Fresh investment from your foreign income, on a repatriable basis |
- Open an NRO (and, if you want, an NRE) bank account, or redesignate your savings account as NRO.
- Open an NRO non-PIS demat and trading account with your broker.
- Move your holdings from the resident demat by an off-market transfer (delivery instruction slip). You do not have to sell them.
- Close the resident demat. Some depository participants now allow the status to be changed on the same account; ask yours.
- Update apps built on your broker (for example smallcase) once the new account is live.
As an NRI, you cannot do intraday trading or short selling in Indian equities, so check any standing strategies.
Mutual funds and SIPs
- Folios do not move with the demat. Update each fund house or its registrar (CAMS or KFintech) with your NRI status, overseas address, FATCA declaration and an NRE or NRO bank mandate. Units held through a broker’s platform may need a separate transfer request.
- SIPs can usually continue once the mandate is moved to an NRE or NRO account. Money invested from your resident savings stays non-repatriable.
- Some fund houses do not accept investments from residents of the US or Canada. Residents of the UAE, Singapore and the UK can generally invest. Check each fund house.
Tax and TDS as an NRI
| Income | What changes |
|---|---|
| Capital gains on shares and equity funds | Still taxable in India. The broker or fund house deducts TDS on the gain at the time of sale or redemption |
| Dividends | TDS at 20%, or the lower treaty rate if you give a Tax Residency Certificate and Form 10F |
| Refund of excess TDS | Only by filing an Indian return; see ITR for NRIs |
